Najib to file contempt of court application against former AG

FORMER Prime Minister (PM) Datuk Seri Mohd Najib Razak will file a contempt application against former Attorney General Tan Sri Ahmad Terrirudin Mohd Salleh this week.

Najib’s lawyer, Tan Sri Muhammad Shafee Abdullah, told reporters today that he had received instructions from the former Pekan MP to file the application tomorrow, or at the latest, Friday, over the AG’s failure to “enforce” the royal addendum in his client’s pardon case.

Muhammad Shafee added that a statement made by PM Datuk Seri Anwar Ibrahim confirmed that Ahmad Terrirudin had received the addendum order from the 16th Yang diPertuan Agong and had passed it to the current Agong.

“We are saying that it is wrong because the addendum is already a decree of a Yang diPertuan Agong.

“The next thing to do is to enforce the addendum rather than pass it to the next Yang diPertuan Agong, because what could he do?

He cannot act as the enforcer of the addendum,” he said in a press conference at the Palace of Justice, Putrajaya today.

Muhammad Shafee said his legal team had previously issued a show-case letter to Terrirudin, to which the latter responded by denying any wrongdoings.  Terrirudin also reiterated that he had no obligation to disclose the existence of the addendum, as the case was still at the leave stage at the time.

On Jan 6, the Court of Appeal returned Najib’s application regarding the royal addendum to the High Court for a hearing.

The 71-year-old former Pekan MP filed his judicial review application on April 1 last year, seeking a mandamus order from the court to compel the government and six other respondents to confirm the existence of the royal addendum.

Meanwhile, Muhammad Shafee said Najib is “contemplating” to file a new pardon application.

“We may do that as well, but again, without prejudice to the rights on the addendum, because that is a separate right given by the Federal Constitution.”

Najib is currently serving his jail term in Kajang Prison, Selangor, after the Federal Court maintained Kuala Lumpur High Court’s decision which found him guilty of corruption involving RM42 millions of funds belonging to SRC International Sdn Bhd, a former subsidiary of the 1Malaysia Development Bhd.

Initially, he was sentenced to serve 12 years jail term and RM120 million fine on Aug 23, 2022.

However, the Pardons Board announced on Feb 2 last year that his sentence was reduced to six years, with the fine lowered from RM120 million to RM50 million.
