THE Federal Territories Pardon Board, responsible for Kuala Lumpur, Labuan, and Putrajaya, reaffirmed its independence following public speculation on its structure and decision-making processes.
In a statement, the Legal Affairs Division of the Prime Minister’s Department (BHEUU, JPM), acting as the Secretariat for the Pardon Board, clarified that the Board operates as an independent entity established under the Federal Constitution.
It emphasised that the Pardon Board is not a governmental agency or department under the Legal Affairs Division.
“The Pardon Board operates autonomously, chaired by the Yang di-Pertuan Agong for the Federal Territories, with the Minister responsible for Federal Territories as a member, in accordance with Article 42(11) of the Federal Constitution,” the statement reads.
The division also highlighted that the Minister in the Prime Minister’s Department (Law and Institutional Reform) does not participate in the Board’s proceedings, administration, or management.
This clarification follows concerns over potential administrative overlap or undue influence in the pardon process.
Furthermore, the Pardon Board’s proceedings are classified under the Official Secrets Act 1972.
“Only Board members and individuals directly authorised by the Board have access to its documents. This safeguards the principles of confidentiality and integrity,” it said.
The BHEUU confirmed that it acts solely as a Secretariat and does not engage with the Minister in charge of law reforms on matters concerning the Board, except as stipulated under the Constitution.
Meanwhile, referring to the Board’s 61st meeting on Jan 29, 2024, chaired by the 16th Yang di-Pertuan Agong, the division confirmed that it had deliberated on the pardon application by former prime minister Datuk Seri Najib Tun Razak (picture).
However, it stated that no additional documents or instructions have since been received from Istana Negara regarding the matter.
“Any misleading statements about the Board’s role or decisions risk undermining its integrity and may prompt necessary action to preserve public confidence,” it warned.
The BHEUU reiterated its commitment to executing its duties with integrity, transparency, and professionalism.
It assured the public that all matters related to the Pardon Board are managed strictly in accordance with the Federal Constitution and existing laws.
The Federal Territories Pardon Board, distinct from state-level pardon boards chaired by the respective Sultan or Governor, oversees cases involving the territories of Kuala Lumpur, Labuan, and Putrajaya.
This clarification aims to dispel misconceptions and ensure accurate public understanding of its independent role.
