KUALA LUMPUR – The Sessions Court here today acquitted and discharged a businessman for dishonest misappropriation of RM10,000 belonging to an oil and gas company by allegedly using the funds for his personal use.
Judge Datin Sabariah Othman ordered Mohamed Noor Mohamed Amin, 50, to be freed after finding the prosecution had failed to establish a prima facie at the end of the prosecution case.
“After hearing the testimony of the prosecution witnesses and the documents presented, the court found that the prosecution failed to establish strong evidence to prove that the RM10,000 belonged to the company, FMG Synergy Sdn Bhd.
“Therefore, there was no evidence to show that the company’s money had been misappropriated by the accused and the court hereby decides that the accused be acquitted and discharged without being called to enter his defence from the charges under Section 403 of the Penal Code,” said the judge.
Mohamed Noor was charged with dishonestly misappropriating RM10,000 belonging to FMG Synergy Sdn Bhdby using the money for his own use, which was to pay his personal credit card bills at a bank in Jalan Ipoh, here on Sept 19, 2018.
The prosecution was conducted by deputy public prosecutor Shakira Aliana Alias, while lawyer Nurul Huda Razali represented Mohamed Noor. – BERNAMA
