SRC case: Defence submits application to recuse CJ

DATUK Seri Mohd Najib Razak’s final appeal over the SRC International Sdn Bhd case today started with his lead counsel Hisyam Teh Poh Teik applying to recuse Chief Justice (CJ) Tun Tengku Maimun Tuan Mat (picture).

The application was filed late yesterday night.

Hisyam told the court that he has decided to counter DPP Datuk V Sithambaram’s arguments on what the court should do if the defence refuses to file oral or written arguments.

Tengku Maimun then decided that the second application should be heard before the Federal Court’s Chief Registrar’s office related to the application to exclude her from hearing Najib’s appeal.

Hisyam said according to the application documents, if relief is granted against the application, the appellant applies for a hearing, and a new panel of the Federal Court is appointed to hear the main appeal.

Najib cited a Facebook post by Zamani Ibrahim who is Tengku Maimun’s husband on May 11, 2018, as the reason for his appeal to recuse the CJ.

“I verily believe that these developments are highly disturbing because Zamani clearly has negative sentiments towards my leadership of this country while I was the prime minister and had concluded that I had siphoned sovereign government funds into my personal accounts.

“Being the husband of the chairperson that is adjudicating my appeal it is likely that he would have influenced the thinking of the chairperson as to my alleged culpability,” he said.

The lead counsel said he was worried that Zamani would influence Tengku Maimun’s thinking on the charges he was facing.

“Based on the above, any findings obtained by this honourable court against me will be doubtful, where an informed and fair-minded observer will think that the results reached are tainted with bias and the public view of the independence of the judiciary will be doubted,” he said.
